How to End a Tenancy Correctly and Fairly

Why the Ending Deserves as Much Care as the Beginning
Sheffield's rental market moves quickly, and it is easy to focus on finding good tenants and forget that the way a tenancy ends matters just as much. A clean, well-documented ending protects your deposit position, keeps your reputation intact and usually gets the property back sooner. It also keeps you on the right side of the law, which in England has become less forgiving of landlords who cut corners. Whether you let a two-bed terrace in Crookes, a flat off Ecclesall Road or a shared house in Broomhill, the same principles apply: correct notice, written confirmation, a proper check-out and a prompt deposit return.
Choose the Right Notice and Get the Dates Right
Before you put anything in writing, be clear about why the tenancy is ending and which route fits.
- Fault-based notice. If rent is unpaid or the tenancy agreement has been breached, grounds-based notice may be appropriate. The notice period depends on the ground used, and some grounds require the court to be satisfied before possession is granted.
- No-fault notice. The rules here have been changing, so check the current position before you act rather than relying on what you did two years ago.
- Mutual surrender. Often the simplest option. If your tenant wants to leave early and you agree, a written deed of surrender with a clear end date avoids arguments later.
Dates catch landlords out more than anything else. Notice periods are calculated in specific ways, and a notice served a day early can be invalid. If the tenancy runs from the 6th of the month, the notice must align with that. For student lets ending in June or July, remember that serving notice in May gives you almost no re-letting window before the September rush, so plan backwards from the academic year.
Serve It Properly and Keep the Proof
Service is where good intentions fall down. Handing a notice to a tenant in a doorway with a friendly nod is not evidence of anything.
- Use the prescribed form where one is required, and fill in every date carefully.
- Deliver by a method you can prove — recorded delivery, a signed hand delivery receipt, or a process server for difficult cases. Email only works if the tenancy agreement allows it and you can show it arrived.
- Keep a copy of everything: the notice, the envelope, the tracking receipt, the date and time. Photograph the documents before they go out.
- Check your compliance first. Deposit protection, gas safety records, energy performance certificates, the right to rent checks and any licence required by Sheffield City Council all need to be in order before certain notices can be valid.
If the tenant is in rent arrears, keep the rent statement up to date. A clear running total, showing payments and the balance, is far more persuasive than a vague assertion that money is owed.
Confirm Everything in Writing
Once notice is served, follow it with a short letter or email that sets out the practical arrangements. This is not a legal requirement, but it prevents almost every misunderstanding that follows.
Confirm the date the tenancy ends, the date and time of the check-out inspection, what the tenant needs to do before leaving, and how the keys should be returned. Remind them about rubbish removal, garden tidying if they were responsible for it, and clearing personal belongings. Be specific: the property must be clear of all belongings and rubbish by 12 noon on the final day is far more useful than a general request to leave things tidy.
Keep the tone warm and practical. Tenants who feel respected tend to leave properties in better condition and are more willing to agree deductions without a dispute.
Arrange the Check-Out Inspection
Offer a check-out appointment at a reasonable time, ideally on or just after the last day, and give the tenant the chance to attend. If they cannot or will not, inspect anyway and note that they were invited.
- Take the original inventory and schedule of condition with you and work through it room by room.
- Photograph everything, including any damage, and photograph the meter readings.
- Test the basics: heating, hot water, smoke alarms, appliances listed in the inventory, and locks and keys.
- Distinguish fair wear and tear from damage. A carpet worn thin after four years of normal use is not the same as a burnt patch or a stain from a spill that was never reported.
- Send the tenant a written summary of what you found, with the photographs, within a few days.
In Sheffield's older terraced housing, damp and condensation complaints are common at check-out. Look carefully at whether an issue is caused by the building or by how the property was heated and ventilated, and record your reasoning.
Return the Deposit Promptly Once Deductions Are Agreed
Deposits must be held in a government-approved scheme, and the clock starts once the amount to be returned is agreed. In practice, aim to settle within a few days rather than waiting for the deadline to arrive.
Send a clear breakdown: the total deposit held, each proposed deduction, the reason for it and the evidence behind it. If the tenant disputes a deduction, try to resolve it directly before it escalates to the scheme's dispute service. Keep your paperwork ready in case it does. Any amount that is not in dispute should be returned straight away, without waiting for the argument over the rest.
Finally, update your records: close the tenancy file, confirm the deposit has been released, note any repairs for the next turn-around, and give the tenant a forwarding confirmation. A well-managed ending makes the next letting start on the front foot.
